about the advice / placement of an au pair and support

By signing the contract, the host family instructs the placement agency to look for an au pair.

§2 duties of the host family

1. The host family undertakes to adhere to the agreements made in this contract.
2. This applies in particular to the following points:
   • Involvement of the au pair in family life, maximum working time of the au pair of 30 hours per week, whereby the maximum daily working time may not exceed six hours, at least one full day off per week, of which at least one day per month Sunday.
   • Free board and lodging if possible with accommodation in your own room.
   • Payment of pocket money of at least € 280.00 / month Opportunity to visit a language school, cover the travel costs to the school and share in the monthly language course costs
     € 70.00.
   • Four-week vacation with continued payment of pocket money for a one-year stay, for shorter stays 2 days per month of stay.
3. The host family undertakes to complete all the necessary registration steps immediately after the au pairs have entered the country; the associated costs are borne by the host family.
4. The host family undertakes to adequately insure the au pair against illness including accidents. As far as possible, the insurance benefits cover the costs of medical treatment, medication and hospital stays.
5. The host family undertakes to notify the agent of the arrival and departure dates of the au pair in writing.
6. If the host family would like to invite an au pair to get to know each other, they undertake to pay the travel costs for the au pair’s return trip.
7. The transfer of data / application documents from au pairs to third parties is not permitted. Applications that are no longer required must be destroyed or deleted immediately. If the au pair data is otherwise mediated through unauthorized disclosure, the host family undertakes to pay the agency commission the lost agency commission.
8. Au pairs from non-EU / EEA countries (with the exception of Switzerland) as well as from EU member state Croatia may be employed for a maximum of one year. The minimum duration is 6 months

§3 Obligations of the agent

1. The mediator transmits the data provided by the au pair to the host family so that they can get in touch with the future au pair
2. The agent does not owe the availability of an au pair, especially during the entire planned stay.
3. If the au pair repeatedly fails to meet the obligations owed from the au pair activity within the first month to a considerable extent, although the host family has demonstrably informed them that they are complying with the obligations, the host family is entitled to be the au pair -Relation to resolve. In this case, the mediator tries to find a new au pair free of charge.
4. A new agency fee has to be paid for the placement of the third au pair. If the host family is dissatisfied with the second au pair, the host family is not entitled to a reimbursement of the placement fee. The host family has to pay the full agency fee
5. If the host family has decided on an au pair, the agency will obtain the au pair’s consent. The agency will provide the information to both parties by mutual agreement.

§4 Liability / Warranty

1. The agent does not guarantee the accuracy or verification of the written information provided by the future au pair.
2. The agent is not liable for damage caused by the au pair to the host family or third parties, for example through illness.
3. The agent is not liable for any disadvantages caused by the sudden cancellation of the au pair, for example due to the rejection of the visa, or for expenses for a replacement.
4. The agent is only liable in the event of gross negligence or willful misconduct
5. Data protection: the host family agrees that the personal data transmitted by the host family will be processed, forwarded to third parties and stored in order to carry out the placement activity, insofar as this is necessary in the context of placement and support activities. It is forbidden to pass on the information of the host family or au pair to third parties.

§5 fees

The host family is ready to bear the costs specified in this contract (see below) for the placement of an au pair. The agreed fee must be transferred to the agent’s agency account within 14 days of the day on which the au pair arrives at the host family.

1. If the host family withdraws from the agreement, the family has to pay the basic fee (deposit = 50% of the total amount).
2. The fee of 580.00 EURO also applies to the au pair invited from abroad. Half of the fee is paid in advance. After the au pair has arrived at the host family, the remaining amount of 290 euros is due for payment.

Amount of the placement fee for an au pair exchange

The amount of the placement fee in the case of an exchange of the au pair depends on the remaining length of stay in Germany. (example: remaining visa 3,6,9 months).

As soon as the change of au pair force arrives at the host family, the placement fee (see below) must be transferred.

§6 withdrawal

1. If the host family withdraws from this contract, there is no entitlement to reimbursement of the placement fee.
2. If the family decides on a candidate, the agency also obtains the consent of the au pair. The CAN-Au Pair agency provides the information to both parties by mutual agreement. (The host family has to pay half of the agreed fee to the agency)

§General

1. Changes and additions to this contract require deormr written form.
2. Services not listed in this agreement are not owed.
3. The person signing for the host family declares to sign this contract for the other part of the host parents and to be authorized to do so. The host parents are jointly and severally liable for the obligations arising from this contract.

Express delivery is recommended for certain countries. These include Russia, Asia, Africa and overseas. In this case, the family can order an express freight order from the agency for € 69.50 (including VAT). If the express mail is delayed or does not reach the host family for any reason, the agency will not be able to reimburse the host family for the express mail charge.
